MINISTERIAL INTERVENTION IN 173 AGREEMENTS IN STONNINGTON

670 Chapel St. Sth Yarra has an extensive planning permit history going back to 2004 when a permit was granted for a 3 level development with basement parking.  

In December 2008 VCAT issued a permit for a 29 storey mixed use development with 164 dwellings, 16,000sq for commercial use, 1000 car spaces with 237 for public use.
 
Subsequent to that decision when there was a relatively minor dispute with Council the Minister intervened and made himself the Responsible Authority, thus ousting Stonnington Council from that position, allowing for an increase in the number of dwellings to 498 and authorising various amendments at the request of the developer.
 
In Feb 2010 DPCD wrote to Council saying that the Minister was considering a request from the land owner for further Ministerial intervention to remove all 173 agreements from the site.   These involved several issues: the provision of 237 public car spaces, road widening, landscaping, provision of traffic lights, etc.
 
Council officers met with DPCD officers and indicated that Stonnington could not consent to such an amendment and sought further information. To date no such information has been received but, on 10 May 2010, Council was advised by the Minister that he had approved an Amendment to end and remove 173 agreements.
 
Council has again and again sought clarification of "what's in and what's out" but no such clarification has been forthcoming even though Council is responsible for planning enforcement.
